Negligence can result in wrongful death

The day starts out like almost any other ordinary day in California. One enjoys a cup of coffee, gets ready for the day and begins with the day's activities. Yet, this is not an ordinary day. This is the day when one unsuspecting family gains first-hand knowledge about wrongful death and the grief it can cause.

Wrongful death is more than just an accidental death. It is death caused by another individual's negligence. As the result of this death, the family suffers financially. In addition, there may be pain and suffering, medical, funeral and other expenses associated with the loss. Therefore, the personal representative for the individual's estate files suit.

There are a number of ways a wrongful death can occur. Often, medical malpractice comes to mind; an individual dies as the result of an incorrect diagnosis or some other such medical concern. Workplace accidents have also been attributed to wrongful death incidents. The worker is exposed to a hazardous substance or condition and dies as a result. In this case, it is possible that the personal representative will file suit.
