Andrew Paz v. Aerojet General Corp and others
- Resolution Date:
- October 1996
- Practice Areas:
- Construction Injuries
- Synopsis:
- Andrew Paz, a 22-year-old driller trainee for Eaton Drilling, was injured at Aerojet General's facility in Rancho Cordova. Aerojet hired defendant McLaren-Hart Environmental Engineering for services including supervising the construction of water wells. Mr. Paz's employer was in turn hired to drill and construct the wells. On the day of the accident, Mr. Paz and a co-worker were trying to hoist a 20-foot-long, 900-pound well casing from a trailer onto a 43-foot-high deck. The stress of lifting the casing snapped the rope that was holding it and the casing crashed onto Andrew Paz's leg. The firm contended that the work method was unsafe, as he was positioned directly in the path of a 900-pound weight restrained only by a frayed, half-inch rope. Moreover, plaintiff argued that defendants took no precautions to eliminate the risk of harm to its employees. The matter settled before trial.
