- On October 25, 1991, Guillermo De Garcia, a 39-year-old carpenter from Mexico, was seriously injured working on the construction site of the Park Regency Apartments in Pleasant Hill, California. De Garcia fell from an unguarded perimeter to the ground below. Three days later, he succumbed to his injuries and died. The plaintiffs included his widow, his three minor children, one adult daughter, as well as his mother, all of whom he was supporting. The defendants were Tricon Builders, Inc., GBW Properties and Park Regency Partners. On three separate occasions prior to Mr. De Garcia's accident the defendants were warned by Cal/OSHA about the lack of perimeter guarding at the construction site. Other subcontractors also complained to Tricon about the lack of guardrails at the site. Plaintiffs contended that defendant Tricon, GBW Properties and Park Regency Partners failed in their duty to provide a safe place to work. The matter settled before trial.
