- Synopsis:
- On September 25, 2003, Jack Smith, a truck driver for Grey Company, loaded twelve empty wine gondolas onto the Grey Companies flatbed trailer for transportation to another vineyard. Smith did not adequately secure one of the gondolas to the trailer. Later that night, Smith was traveling south on Highway 121 when the unsecured gondola fell off the trailer and came to rest in the middle of the unlit highway. After about six minutes plaintiff, John Doe, was driving his car south in the same location. He collided with the gondola and ricocheted into oncoming traffic, crashing head-on into a Buick. John Doe suffered a collapsed lung, multiple rib fractures, torn ligaments, and severe facial and neck scarring. The severe facial scarring that John Doe experienced, caused a decrease in his work performance as a sales representative. His employer fired him shortly after the accident. The matter settled before trial.
