- Joe Doe, a printing press operator, suffered injury while operating a two-color printing press. The injury occurred at the point of operation, an unguarded in-running nip point. Defendant Printing Press Manufacturer argued that the hazard was originally guarded and the company had been conducting a warning and retrofit program. Plaintiff argued that the product was defective and that defendant negligently conducted its warning and retrofit program. Plaintiff suffered a below the elbow amputation to his right dominant hand and forearm. The matter settled before trial.
