The Veen Firm Files Lawsuit: Untrained & Unlicensed Security Guard Brutally Attacks Patron at Sacramento Bar

The Veen Firm filed a lawsuit against the restaurant/bar The Red Rabbit and Tyler Erickson, one of the establishment’s security guards, on behalf of KS, who was physically removed from the venue and then beaten. The complaint alleges battery and negligent hiring, training and supervision.

“Bars and restaurants that serve alcohol such as The Red Rabbit have a duty to ensure that their staff and security are properly trained and their premises are operated so that their patrons are safe,” said lead counsel Elinor Leary. “Rather than de-escalating the situation, The Red Rabbit allowed its security guard to use excessive force resulting in the brutal attack of KS. This would not have happened had the venue used properly trained and licensed security guards.”

Background

In the early morning hours of July 25, 2015, KS was displaying rowdy behavior at The Red Rabbit. When it was brought to the security guard’s attention, Erickson – the on-duty guard – placed KS in a headlock and dragged him outside the venue rather than escorting him safely off the premises. Once KS was outside the bar, Erickson slammed his face onto the concrete and continued to violently attack him.

The lawsuit alleges that The Red Rabbit negligently and maliciously breached its duty of care by using inappropriate, excessive and unreasonable force against KS. Neither Erickson nor The Red Rabbit were licensed with the Bureau of Security and Investigative Services as required by California Business and Professions Code. The Red Rabbit’s failure to employ licensed security at the time of the attack also violated the alcohol license issued to the bar by the California Department of Alcoholic Beverage Control.

As a result of the violent attack, KS sustained life-altering injuries. He has been undergoing treatment since the attack, including treatment for dental injuries and fractured facial bones.
