Careless Cement Truck Driver Runs Into Construction Worker

Synopsis

In August 2016, PF was part of a construction crew that was constructing a center median along several blocks in San Jose, California. That afternoon, PF was doing his assigned work in the median in front of a parked cement truck operated by Granite Rock Co. While working, PF repeatedly looked up at the parked truck, confirming that the driver’s seat was empty. Soon after, the Granite Rock Co. driver got back in his truck without doing any type of “walkaround” to check the truck’s blind spots, then pulled forward and collided with PF. PF was checked out at the hospital but released that day with almost no listed injuries.

Plaintiff Allegations

The Veen Firm’s investigation revealed that PF had a labral tear in his hip. He also as diagnosed with post-concussion syndrome. He underwent several procedures to improve his hips following the incident, but never returned to full duty work.

Result

The Veen Firm obtained a settlement $2.05 million for PF.
