Trial Team Leader Anthony Label and Attorney Steven Kronenberg filed a lawsuit on behalf of bicyclist Ty Whitehead against the City of Oakland, County of Alameda and State of California for dangerous conditions of public property after Whitehead’s bike collided with a large pothole on Skyline Boulevard in Oakland, resulting in a serious brain injury.
In March 2017, Whitehead was on a training ride for the 2017 AIDS/LifeCycle Ride in Oakland when he hit a pothole in the road, went over the handlebars, and hit the road head-first. He lost consciousness on impact and was in a coma for about two weeks.
The lawsuit alleges that liability for Whitehead’s collision rests with the City of Oakland, County of Alameda, and the State of California, because the area of the collision presented a dangerous condition of public property. “Skyline Boulevard was poorly maintained and dangerous for cyclists,” said Kronenberg.
