A combined $29 million resolution, the largest known recovery in a California medical malpractice case

The Veen Firm LLP with co-counsel Walkup, Melodia, Kelly & Schoenberger recently resolved a medical malpractice case for a combined total of $29 million from an individual health care provider and two institutional defendants. Based on the firm’s research, it is the largest known recovery in a California case involving only medical malpractice claims governed by MICRA, California’s Medical Injury Compensation Reform Act. Partner Theo Emison led the matter.

The case followed a pattern common to healthcare litigation: multiple defendants, contested causation, and a coordinated argument that every provider met the standard of care.

Emison brought the case to resolution with targeted discovery establishing the defendants violated hospital policies and procedures intended to protect patient safety, and by digging deep into discovery to access text communications between physicians not included in the patient’s medical records that exposed a conflict between the testimony of two physicians involved in the case.

“Cases like this are not won in a single moment. They are built, piece by piece, over years,” said Emison. “This outcome came from persistence: obtaining the institutional defendants’ policies and procedures, confirming those policies were intended to protect patient safety, establishing those policies were violated, taking deposition after deposition to hold the defendants’ feet to the flames.”

“Institutions of this scale rarely resolve substantial cases without a fight,” Emison added. “Our client deserved that fight, and we were prepared to take it as far as it needed to go.”
