Anthony Label and Steven Kronenberg Obtain $10 Million Potential Value Nationwide Class Action Settlement in Mercedes Benz Sprinter Van Leaky Roof AC Units

SEPTEMBER 6, 2016

As published in Daily JournalAutomotive News and others, on August 30, 2015, The Hon. U.S. District Judge Thelton E. Henderson approved the settlement of a class action lawsuit against Mercedes Benz for selling Sprinter vans with roof air conditioners that leaked so much water that passengers described it as “raining” inside the vehicle. Plaintiffs are represented by Anthony Label and Steven Kronenberg of The Veen Firm and by Jonathan Gertler, Daniel Gildor, and Samuel Cheadle of Chavez & Gertler, LLP.

The settlement extends the warranty on about 10,000 Freightliner and Mercedes Sprinter vans nationwide. Each Sprinter van roof air conditioner leak repair is estimated to cost between $500-$1,000. According to plaintiff’s counsel Anthony Label, the settlement “is a fair and reasonable resolution of Mercedes Benz USA’s exposure, and a very favorable result for the Sprinter owners’ claims, who will have these defective vehicles repaired free of charge.” Mercedes Benz USA disputes liability and damages.

Mercedes defective AC class action lawsuit settlement Class Members include all U.S. residents who are current and former owners/lessees of model year 2010-2014 Mercedes-Benz and Freightliner Sprinter 2500 or 3500 vehicles with original-equipment rear air conditioning units who purchased or leased their vehicles in the U.S.

The Mercedes Sprinter Van Class Action Lawsuit Settlement is Digby Adler Group LLC v. Mercedes-Benz USA LLC et al., Case No. 3:14-cv-02349, in the U.S. District Court for the Northern District of California.
